THE FOLLOWING TWO CASE FOOTENOTES REFERENCE TWO SITUATIONS
ONE WITH AND ONE WITHOUT VIDEO CLIPS

“Based upon the absence of the plaintiff, and the fact that the deposition was not videotaped, the court could make no assessment of the plaintiff except through the printed word, a very poor substitute for testimony.” Chan v. Chan, No. FA93-0525491, 1999 WL 350169, at *1 (Conn. Super. Ct. May 14, 1999)

Other courts have concluded that the fact that an unavailable declarant’s statement was video recorded
militates in favor of admissibility because the jury can assess the declarant’s demeanor at the time
the declarant made the statement.” Skakel v. State, 295 Conn. 447, 624 (2010)

COURT APPEARANCES, DEPOSITIONS, PROBATE HEARINGS, ARBITRATION HEARING and LAND ISSUES USING OUR DRONES

As a valid and approved media organization by the Chief Court Administrator for purposes of videotaping court proceedings in Connecticut, American News and Information Services Inc. has chosen to offer video recording services to attorneys and members of the public

American News has a long history of recording breaking news situation, and recently began to record Depositions, Probate and Arbitration hearings and land issues through the use or our Drones.

We are convinced that video adds a third and arguably crucial dimension to the deposition process, (or any situation where a person is testifying under oath.) Video permits everyone the ability to assess the demeanor of witnesses and the credibility of testimony in preparation for use at trial.

In the 21st century there is no reason why videotaped depositions should not be the default method for preserving testimony using readily accessible and affordable technology to exponentially increase the value of the result.

We suggest that those who want a written transcript, provide a copy of the video recording to a transcription service where the video’s audio track may be transcribed by the client and their attorney.

ADDITIONAL FACTS ON VIDEO DEPOSITIONS

State and federal rules have recognized the value of videotaped depositions by expanding their permissibility.

Connecticut state courts and federal courts with limited exception, do not allow a party to object to a videotaped deposition where there is procedural compliance with the rules.

To encourage the use of videotaped depositions as the default method of preserving testimony, American News and Information Services will work with any attorney who desires a video recording of any reasonable event.

For additional information including a list of the equipment available for videotaping a deposition of your client, and/or the the review of a client’s demeanor while being deposed.

The preparation and review of a clients demeanor and visual presence while being questioned under oath is considered by some to be a very valuable tool in preparing a client for a deposition or trial.
